MOBBING, THESE ARE THEIR STORIES/ OVO SU NJIHOVE PRIČE

U Liliju za platu od 17.000 dinara nesmeš da sedneš, i šef ti ne dopušta da koristiš slobodne dane, pa u mesecu od trideset imaš samo dva slobodna dana? Da li ima neke razlike izmedju rada u Maksiju, Lily drogerijama, Štampinim kioscima i robovlasničkog sistema?
 Možeš da se okreneš i napustiš posao, to je jedina razlika. Uskoro će  u Srbiji uvesti zabranu davanja otkaza.  Iste su plate i na drugim mestima, a oni dobijaju olakšice od države, ucenjuju dobavljače jer su monopolisti, cene veće duplo u odnosu na razvijene zemlje. Čokolada Milka -1 euro, u Nemačkoj ista košta pola eura. Niko ne sprečava eksploataciju i mobing. Oni na tri mesta imaju ekstraprofit, malo plaćena radna snaga, monopolisti pa ucenjuju dobavljače, a pošto nemaju konkurenciju, cene formiraju, kako žele. 
31. januara sam dobila otkaz, pre toga dva puta su mi smanjili platu za godinu dana i to drastično, tražili da radim prekovremeno i kad nema posla? 
Radila sam po 10 do 12 sati kad je bilo potrebno, trpila mobing i od kolega i od nadredjenih, odbijala da maltretiram radnike, kad sam kao stručna postavila posao na noge, dobila sam otkaz, jer gazdi firme se nije dopalo što sam izašla u 5h i 15 min sa posla (radno vreme mi je do 5h),a on je tu i svi su ostajali prekovremeno iako nema potrebe.Odbila sam da radim subotom, mada sam dolazila kad je posao zahtevao.... Sad je za mene ostalo Maxi, Lily, Štampa kiosk..... Tako je u Srbiji kad si sposoban, pametan i kad imaš stav! U zavodu za nezaposlene administracija brojna i uz to- ništa nerade!!?? SRBIJO!

        Da nisu samo privatni poslodavci i njihovi menadžeri za ljudske resurse skloni da krše radna prava zaposlenih, potvrdjuje i  moj slučaj.  Zaposlena sam  u jednom javnom preduzeću. Pre dve godine na mesto šefa službe u kojoj radim, došla je nova koleginica koja se odmah ustremila na mene.
 Za početak, obavezivala me je da radim poslove koji nisu u opisu mog radnog mesta, insistirala je da na poslu ostajem gotovo svaki dan nakon isteka radnog vremena. Kada sam se, posle nekoliko meseci, pobunila i zahtevala da mi se obračuna i isplati
prekovremeni rad, usledio je šok. 
Nova šefica je izjavila da će mi zarada biti umanjena jer ne radim dobro, odnosno da nisam na vreme i kvalitetno uradila poslove, upravo one koje mi je ona nametnula, a nisu u opisu mog radnog mesta i u okviru moje struke. 
Pokušala  sam da se požalim direktoru, ali nikada nije hteo da me primi.  Napokon, obratila sam se sindikatu, ali ni od toga nije bilo vajde, već je šefica još žešće krenula da me angažuje da radim više sati nakon radnog vremena. 
Čaša se prelila kada sam zatražila da odem na godišnji odmor, a šefica mi je odgovorila da od toga nema ništa, posebno zato što sam ja u pitanju. 
Ni prijava inspenkciji rada nije urodila plodom, a trenutno sam pod stresom i trpim njegove posledice, odnosno lečim se na kardiološkom odeljenju jedne klinike u Beogradu. 
Kolege sindikalci smatraju da za moju bolest zaista treba da odgovara šefica, ali i direktor. Gde je i kolika je njihova odgovornost, to ne žele da kažu, odnosno navode da sada preduzimaju sve da se ovakvo šefovsko ponašanje spreči, kao i da se  šefica više tako ne ponaša. Toliko od sindikalaca. 
 Što se mene tiče, poručila sam nekim kolegama da neću sedeti skrštenih ruku, već da ću argumentima, na sudu, dokazati da su mi kršena radna prava i  tražiću i novčano obeštećenje za narušeno zdravlje.

 Fellow trade unionists believe that for my disease really need to match the head, and director. Where and what is their responsibility, they do not want to say or suggest that now all taken to prevent this kind of bossy behavior, and more so the boss does not behave. So much for the trade unionists.
 As for me, I told some colleagues that I will not sit idly by, but I'll arguments in court to prove that we have violated labor rights and will seek monetary compensation for the impairment of health.

Radim u javnom komunalnom preduzeću  u Boru od maja 2001 god. U junu 2010 godine snimio sam tri osobe kako čerupaju imovinu firme i od tada trpim mobing. Najpre su pokusali da mi smeste 3 neopravdane šihte, zatim  je usledila promena radnog mesta, zatim su me klevetali napismeno, zatim  su me diskriminisali zbog toga sto nisam vlah, najmanje 12 puta sam se javio lekaru zbog psihičkog maltretiranja. Obraćao  sam se napismeno direktoru preduzeća koji je takodje vlah, smanjili su mi platu, pisao sam predstavke da prestanu da me maltretiraju i evo i dan danas trpim mobing.
I work in a public utility company in Bor since May 2001.June 2010 I recorded three people that  steal a lot of property company and has since  they put up me with mobbing. First, director tried to  me accommodate 3 šihte unjustified, then came the change of job, then they slandered me in writing, then they do it discriminating against me because I am  not Vlach, at least 12 times I called the doctor because of psychological harassment. I contacted the company in writing to the Director- who is also Vlach and decreased me , I wrote a complaint to stop harassing of  me but I still put up with bullying at work.

   Radim kao ekonomista na radnom mestu službenika u državnoj službi. Očekujem odluku disciplinske komisije  koju je sazvao jedan od mojih šefova u posebnoj organizaciji u državnoj upravi. Ljutiti šef hoće da istera pravdu po svom aršinu, jer sam ja samo htela da on potpiše rešenje za radno mesto na kojem već godinu dana savesno i dobro radim . Za isto imam stručnu spremu, a ono je u ovoj organizaciji i upražnjeno.
Radila sam poslove koji su po svim pravilima i dokumentima firme predvidjeni za to radno mesto, a mnogi nadredjeni su ocenili da ih radim za ocenu “vrlo se ističe” ili “ističe se”, što znači odlično ili vrlo dobro. Pored toga,prihvatala sam i poslove za privatne potrebe šefa. Dugo sam radila poslove koje bi trebalo da rade tri zaposlena. Uspevala sam da ih uradim bez greške i u roku. 
Kad sam od šefa zatražila da mi potpiše rešenje za pomenuto upražnjeno radno mesto, odnosno da radim poslove u skladu sa visokom stručnom spremom koju imam, usledile su uvrede i ponižavanja.  Da bi me još više ponizio, naredjivao mi je i da radim poslove koji nisu vezani  za moje radno mesto. 
Naredjivao mi je da radim i poslove vezane za njegove privatne potrebe.
Kada je postalo neizdrživo  pokušala  sam  argumentovano da mu predočim svoja prava i ukazala sam mu na njegove nekorektne postupke prema meni  a on je odgovorio lažnom optužbom da sam ga vredjala.
Zatim je sazvao i disciplinsku komisiju.
Ne znam kako će se sve okončati.  Teško mi je, ali neću odustati od borbe za svoja prava i pravdu. Ne znam šta ću preduzeti,  jer moji postupci zavise od odluke komisije. Spremna sam da se borim,ali očekujem i pomoć sindikata , I da dodam da mi je šef poručio da ne očekujem da ću ikada dobiti radno mesto na koje imam pravo i koje ostaje upražnjeno.

      U jednoj državnoj ustanovi radila sam 11 godina. Poslednje četiri godine bila sam žrtva  mobinga. U početku, suočila se sa namerom šefova da me prebace na drugo radno mesto, a potom sam doživela da mi oduzmu osnovno sredstvo za rad (računar). 
Da mukama nema kraja,  uverila sam se u trenutku kad sam morala da radim svakodnevno i dobijala sam sve više radnih obaveza, a da za to nisam bila nagradjena i plaćena. Najstrašnije je bilo to što je u kancelariji do moje radila žena koja je najveći deo radnog vremena provodila hodajući po kancelarijama, čitajući novine i skupljajući tračeve.  Imala je moju skoro duplu platu, a pri tom sam ja radila njen posao. 
Šefica je pri tom uvek koristila svaku priliku da me ponizi i povredi.
Osećala sam strašan pritisak. Samo jedan dan mog odsustvovanja s posla, kao rezultat je imao to da vi-pe nisam mogla posti}i da izvr{im svoje radne obaveze. Kad sam se razbolela i od lekara dobila preporuku da mirujem par dana, šefica me je prvog
dana bolovanja nazvala i poručila, ako neću da radim da ima ko hoće.
Uslovi rada su bili nepodnošljivi i nemogući, pa sam na kraju odlučila da odem odatle. Strašno je to što me i dalje kleveću i ogovaraju. Šefica čiji sam veliki deo posla odradjivala, jer nije znala da radi na računaru ( ili se pravila da ne zna), ima stalnu potrebu da i sad, kada sam otišla, za sve propuste krivi mene. 
Zadovoljna sam i srećna na novom radnom mestu, ali je tragedija da radnike maltretiraju oni koji svoje lične komplekse i frustracije leče na drugima.

Working conditions were intolerable and impossible, so I finally decided to go there. It is terrible to me it still slander and gossip. I am satisfied and happy at the new job, but it is a tragedy to those workers who harassed his personal frustrations and complexes to treat others.

     Branko je bivši radnik velikog preduzeća, koje je pre koju godinu kupila jedna strana kompanija. Prema njegovim rečima, zbog ugovora koji je ta firma sklopila sa državom, poslodavac nije mogao da uruči otkaze onima koje je smatrao prekobrojnim, ali se broj zaposlenih ipak smanjio korišćenjem jednog perfidnijeg metoda. 
 Branko kaže da su od momenta dolaska novog vlasnika suspendovana  radnička prava i započet je proces masovnog psihičkog zlostavljanja.
"Nikakva prava nismo imali, počevši od sindikalnih, pa do poslovnih. Odjednom, niko nije znao ko će i kad biti pozvan na stručni sastanak, na koji ćemo posao biti preraspodeljeni, za koga radimo i zašto radimo?", kaže ovaj Novosađanin za 021. Prema njegovim rečima, radnicima koji su se našli na listi za odstrel  plate su spuštene na minimalac, nakon čega im je ponuđena otpremnina.
Ovaj bivši radnik jedan je od mnogih koji su odlučili da uzmu otpremninu i sami odu, jer bi u suprotnom bio psihički zlostavljan i otpušten bez otpremnine, kada ugovor to dozvoli. "Ukoliko ne uzmeš mere koje su ti ponuđene, počinje proces. Najpre ti se plata spušta na minimalac, onda slede ostale neprijatnosti, a za svo to vreme ne postoji niko ko može da vam pomogne, jer je sindikat kupljen", kaže Branko za Radio 021.

Direktor škole uništava me i danas

Kao rukovodilac računovodstva u Višoj školi za obrazovanje vaspitača, radila sam punih 19 godina. Zbog nezakonitog rada direktora škole M. P. bila sam prinuđena da ga prijavim nadležnim organima da bih zaštitila svoj lični i poslovni integritet, a istovremeno i ustanove u kojoj sam radila. Zbog obraćanja tužiocu i policiji bila sam psihički zlostavljana, zlostavljana na poslu i to pismenim naredbama da u najkraćem roku obavim zadate poslove. Direktor je prestao sa mnom da komunicira i za sve važne konsultacije obraćao se drugoj službenici. Bila sam izolovana od kolektiva jer niko nije smeo javno da razgovara sa mnom, ali su se zato van škole ili telefonskim putem izvinjavali. Svi su mi govorili da ne smeju da pričaju s mnom, u protivnom preti im otkaz.

Nepravilnosti u mom radu nije bilo. U svojoj nemoći, direktor je posegnuo za izmenom Pravilnika o sistematizaciji radnih mesta. Novim pravilnikom predviđa posebne uslove za šefa računovodstva - ekonomski fakultet i položen stručni ispit za vršenje poslova samostalnog vođenja poslovnih knjiga. To je uradio da bi stvorio mogućnost za moju eliminaciju sa tog radnog mesta.

Završila sam višu ekonomsku školu, imala sam 19 godina rada na poslovima samostalnog vođenja knjiga u istoj školi, od ukupno 23 godine staža, položen stučni ispit, zvanje samostalnog računovođe, završenu školu za rad na računaru. Na osnovu oglasa za popunu radnog mesta šefa računovodstva prima drugo lice, a da moj radni status nije rešio. Tri meseca sam bila na bolovanju zbog herpesa dobijenog zbog stresa.

Mobing je moja svakodnevica. Posle tri meseca dolazim na posao i nakon deset minuta dobijam rešenje da je za mojim radom prestala potreba i da me šalje na plaćeno odsustvo u trajanju od 45 radnih dana, a nakon toga šalje me na godišnji odmor. Po isteku odsustva i godišnjeg odmora dobijam rešenje o prestanku radnog odnosa kao neraspoređen radnik. Povela sam radni spor. Dobijam spor. Istovremeno je Opštinsko javno tužilaštvo na osnovu moje prijave zbog davanja nezakonitog otkaza podiglo optužnicu protiv direktora. Do danas taj process nije okončan.

Direktor je podneo predlog za reviziju Vrhovnom sudu i na moje zaprepašćenje Vrhovni sud ukida odluke nižih sudova, proglašava da je tužbeni zahtev neosnovan i odbija ga uz obrazloženje da za mene nije bilo drugog radnog mesta u školi ni van nje. Uz nove dokaze da je po sistematizaciji bilo slobodno mesto knjižnjičara u biblioteci, pokrećem novi zahtev za obnovu postupka. Moj zahtev nije prihvaćen i tako sam iscrpla sve zakonske mogućnosti za pravednim rešenjem. Jedino što sam dobila je nalog da platim sudske troškove i troškove advokata koga je škola angažovala.

Moj zlostavljač je i dalje direktor sa 66 punih godina života. Pošto, izgleda, o njegovom odlasku u penziju, odlučuje on lično (nadležni organi ne žele da primene zakon) ostaće direktor do kraja života. Kada je on u pitanju, očigledno je o kakvoj se ličnosti radi, kao što je i potpuno jasno da sam ja žrtva brutalnog mobinga  koji se nada mnom vrši, nažalost, uz podršku sudova i Ministarstva prosvete.
Smatram da su mi ugrožena ljudska prava, Ustavom zagarantovana, i tražim zaštitu i pravdu za sebe i svoju porodicu.

Mitomito-i-korupcija i korupcija među inženjerima

     Žrtva je više puta obaveštavala razne institucije da je progonjena nezakonito, sramotno i nemoralno od rukovodstva svoje firme. Generalni direktor podneo je prijavu protiv nje za navodnu klevetu sa neosnovanim i izmišljenim razlozima i obrazloženjima. Žrtva, koja ima duži radni staž u firmi u odnosu na druge diplomirane inženjere, raspoređena je na neadekvatno radno mesto gde njene kvalifikacije i iskustvo ne mogu da dođu do izražaja. Gotovo trideset godina radi u istoj firmi. Tokom radnog staža vršila je stručni nadzor nad važnim poslovima, ukazivala na brojne propuste kod ugovaranja i izvođenja radova.

Sve je počelo raspisivanjem javnog konkursa za isporuku i montažu 129 klima uređaja (vrednosti  preko milion evra). Upoznata sa činjenicom da će se dva puta ugovoriti montaža radova, žrtva o tome pismeno obaveštava direktora upozoravajući da će firmi biti pričinjena šteta oko 250.000 evra, kao i da postoji osnovana sumnja da su radovi na drugim objektima ugovarani sa oko 30 % većom cenom od tržišne.

Žrtva je poslala 18 prijava Ministarstvu rada, ministru i Inspekciji rada u vezi sa ovim slučajem. Išla kod inspektora i podnela  oko 15 prijava Ministarstvu za kapitalne investicije, ministru i inspekciji tog ministarstva, oko 10 prijava Upravi za javne nabavke republike Srbije i direktoru te uprave, ali ništa konkretno niko nije preduzeo.
Dok je na godišnjem odmoru, u pomenutoj firmi za personal donose rešenje sa iskonstruisanim obrazloženjem po kojem je žrtva raspoređena na radno mesto u Pančevu. Cilj je jasan: kao nezgodnog svedoka žele da je udalje iz Beograda. Ona odmah podnosi tužbu nadležnom sudu protiv tog rešenja. Za tri godine nije održano nijedno ročište. Ne znajući više šta da radi, sva pisma koja je slala direktorima, sada je predala novinaru lista Balkan. Objavljen je članak. Nakon toga žrtvi su vrlo retko dodeljivani poslovi i to minimalnog obima, a plata joj je smanjena. Tek nedavno sam shvatila da problem vezan za mene i moj posao ima svoje ime i da nisam usamljena u njemu. Na neki način bilo mi je lakše. Videla sam način kako da pokušam da rešim svoj problem koji traje već 3 godine. Naime, radim na Kopaoniku već 20 godina. Radila sam na radnom mestu domaćice hotela. Tada je na Kopaonik "doveden" A. J. sa suprugom i postavljen na mesto upravnika hotela a njegova supruga na mesto domaćice. To znači da sam ja bila pomerena sa svog radnog mesta bez ikakve prethodne najave, upozorenja, obrazloženja... To je za mene bio šok. Raspoređena sam na mesto nadzornice u hotelu.

Sve to veoma teško sam podnela, pala sam u depresiju, suze su bile deo mog svakodnevnog života. Shvatila sam da postoji ogromna količina ljudske zlobe i zavisti. Videla sam koliko su ljudi spremni nisko da se spuste, da pogaze osnovne moralne vrednosti da bi ostvarili svoje ciljeve. Napominjem da sam pobornik ideje pozitivnog razmišljanja, pozitivne energije, ali sam tada, kao i sada,  počela da sumnjam u sve to. Tražila sam pomoć od pravnika u firmi, Inspekcije rada, ali, nažalost, svi su mi rekli da je sve po pravilu i pravilnku firme. Direktor može da te rasporedi na bilo koje radno mesto. Pomenut je i otkaz ugovora ukoliko bih nastavila da isterujem pravdu.

Direktor je mom mužu rekao sve najgore o meni: da sam arogantna, preterano ponosna, da sve gledam sa visine, da uvek ističem svoje obrazovanje, da me niko ne voli… Suprug je pokušao da me brani, ali bezuspešno. Razgovor je završen bez ikakvih rezultata. Direktorova je bila poslednja. Zahtevao je da "spustim loptu" i da prihvatim ponuđeni posao jer to je, po njegovom mišljenju, moj maksimum.
Kako naći izlaz iz ovakvog stanja, nisam pametna.

  U preduzeću u kome sam zaposlen postoje nezvanične „liste" podobnih i nepodobnih, dakle onih kojih se treba otarasiti. Već nekoliko meseci, zajedno sa kolegama koji su „višak" , smešten sam u potkrovlju, u kancelariji bez prozora. Ne daju nam nikakva zaduženja, plate nam smanjuju. Niko nam se ne obraća. Čekaju da sami odemo. Firma je privatizovana, ali po ugovoru ne smeju da nas otpuste. Gde da odem, kad sam u preduzeću proveo 23 godine i od plate izdržavam četvoročlanu porodicu? - pita se radnik Predrag V. u razgovoru za Danas.
