MAKEDONIJA:Ni jedna žrtva nije dobila spor protiv mobinga/ Not one of the victims has not won the case against mobbing

 Na  zlostavljanje na radnom mestu najviše se žale radnici u tekstilnoj industriji, administraciji i finansijama, kažu u  specijalizovanoj kancelariji
za pomoć i edukaciju žrtvama mobinga na SSM.
 
Zaposleni u privatnom preduzeću za nekretnine i marketing žalili su se da prethodne 2,5 godine trpe psihičko maltretiranje na radnom mestu od strane poslodavca. Zaposleni su dobijali hitne dnevne zadatke, ostajali su prekovremeno na poslu a  pritom im je u pojedinim periodima,  bez objašnjenja umanjena plata.  

Kao posledica toga, počeli su da doživljavaju česte glavobolje, stres, umor, nesanicu i nedostatak spremnosti da rade, za šta postoji  i medicinska dokumentacija.
 Neretko  bili su ismevani pred kolegama. No, i pored toga, zaposleni se nisu odlučili da pokrenu sudski spor, zbog straha od gubitka posla. Ovo je jedan od primera zabeleženih od strane stručnog tima Kancelarije za pomoć i edukaciju žrtvama mobinga na SSM.

U anketi koju je nedavno sprovela Kancelarija  na 3.000 distribuiranih upitnika za utvrđivanje mobinga pozitivno je odgovorilo njih 1114. Mobinga - kažu u Kancelariji ima u svim aktivnostima. 

Samo 44 odsto ispitanika je reklo da se osećaju kao žrtve takvog zlostavljanja. 
Većina onih radnika koji su se žalili su iz tekstilne industrije.Oni rade u neodgovarajućim uslovima i najslabije su plaćeni. Prate ih uprava i finansija. Manje žalbi ima  u obrazovanju, policiji i pravosuđu.

Maja Ristova član ekspertskog tima Kancelarije rekla da je do sada u našoj zemlji, uprkos brojnim izveštajima o mobingu, nije bilo pozitivnih ishoda u korist žrtve.

- Ali to ne znači da radnici treba da se obeshrabre. Osoba koja se oseća ugroženom u svom radnom okruženju, prvo treba da pokuš,  da tamo da reši problem. 

To znači da najpre razgovaraju sa moberom, informišu se i zahtevaju pomoć pretpostavljenih mobera, kao i pomoć od  službe  koja upravlja ljudskim resursima ili od sindikata. Za period u kome je bila izložena mobingu, žrtva treba da sačuva  kopije pisama, e-mailova, faksova, SMS-ova, što će potvrditi zlostavljanje. Većina odgovarajućih dokaza psihološkog poremećaja je medicinska dokumentacija - objašnjava Ristova.

Duško Minovski, sociolog i direktor Komisije za prevazilaženje diskriminacije, kaže da je Vlada svesna brojnih žrtava mobinga, tako da Skupština sada radi na odgovarajućem zakonu.

- Verovatno će biti spreman da uđe u skupštinsku proceduru do kraja meseca. Istina je da ne postoji bilo kakav sudski spor rešen u korist žrtve. Razlog tome je nepostojanje posebnog zakona o mobingu - kaže Minovski.

Prema rečima stručnjaka, mobing je specifičan oblik ponašanja na radnom mestu, kada jedna ili više osoba sistematski psihički uznemirava drugu osobu ili više njih, ugrožavajući im ugled, čast, dostojanstvo i integritet istih.

- Istraživanja  naše kancelarije pokazuju da  je mobing prisutan  u svim oblicima , od mobinga među kolegama do mobinga  od strane pretpostavljenih. Prema ovom istraživanju, kao zlostavljači poslodavci se javljaju u 89% slučajeva, a saradnici u 8 odsto. Najčešće mobing prijavljuju radnici, 69 odsto, ali postoje i izveštaji od ljudi na višim pozicijama poput menadžera i administratora, kojih doduše ima veoma mali broj, ali ih ima - kaže Ristova.

Ona dodaje da, ako postoji mobing, ova kancelarija pruža besplatnu savetodavno- pravnu pomoći. Postupak  pomoći "žrtvi" sastoji  se od toga da  uradimo prijavljivanje , saslušamo ih i uputimo na dalji postupak.

- Nudimo vansudsko ili sudsko rešavanje slučaja, kako već želi zlostavljana osoba. Vansudskim rešavanjem spora ili medijacijom, dosada su rešena tri slučaja, dok je tužba podneta sudu u šest slučajeva mobinga, čiji postupak je još uvek u toku.

 Ponekad osoba koja traži savet ili pravnu pomoć, nema želju da se nešto više uradi, iz različitih razloga. Najčešće to je nedostatak poverenja u pravosudni sistem, dugo trajanje postupaka, narušavanje zdravlja - mentalna kriza, gubitak volje za životom, suicidalne misli, razlozi finansijske prirode, strah od vođenja bitke sa "moćnijim" neprijateljem i strah od nemogućnosti da se pronađe drugi posao. Retki su slučajevi u Makedoniji  da zaposleni digne ruke  od svega i da napusti svoj posao, rekla je ona.
Posledice mobinga utiču na život žrtava.

On harassment in the workplace complains most workers in the textile industry, administration and finance, said in specialized offices.

Employees are given immediate daily tasks, stayed long hours at work, pushing them in certain periods of reduced wages without explanation.
As a result, they began to experience frequent headaches, stress, fatigue, insomnia and lack of willingness to work, for which there is medical documentation. Frequently, they were ridiculed in front of peers. But in spite of that, the employees have not decided to launch legal action over fears of job losses. This is one of the examples reported by the expert team of the Office for assistance and education to victims of mobbing in the SSM.
In a survey recently conducted by the Office of 3,000 distributed questionnaires to determine mobbing positively responded 1114
employees.
Mobbing say the Office in all the activities.
Only 44 percent of respondents said they feel like victims of such abuse. Most of those employees who complained were from the textile industry. They working in unsuitable conditions and are paid the least. Followed by administration and finance. Has less appeal in education, police and judiciary.
May Ristova member of the expert team of the Office said that so far in our country, despite numerous reports on mobbing, there were no positive outcome in favor of the victim.
- But that does not mean that workers should be discouraged. A person who feels threatened in its operating environment, first we should try to solve the problem there.
That means you first talk to Moberly, inform and require the assistance of Moberly superiors, as well as assistance from the Service that manages human resources or union. For a period in which she was exposed to mobbing, the victim should keep copies of letters, e-mails, faxes, SMS messages, as verified abuse. Most psychological disorders appropriate evidence medical records - Ristova explains.
Bugs Minovski, a sociologist and director of the Commission for overcoming discrimination, said the Government was aware of the many victims of mobbing, so that the Assembly is now working in the relevant law.
- It will probably be ready to enter the parliamentary procedure by the end of the month. It is true that there is any legal dispute is resolved in favor of the victim. The reason for this is the absence of a special law on mobbing - Minovski says.
According to experts, is a specific form of bullying behavior in the workplace, where one or more persons systematically mentally disturbing another person or several, endangering their reputation, honor, integrity and dignity of the same.
- Research shows that our office mobbing present in all forms of mobbing among colleagues to mobbing by superiors. According to the survey, employers abusers as occurring in 89% of cases, and associates at 8 percent. Frequently reported bullying workers, 69 per cent, but there are reports of people in higher positions such as managers and administrators, which admittedly has a very small number, but it has - says Ristova.
She adds that if there is bullying, this office provides free counseling and legal assistance.

  Sometimes a person seeking advice or legal assistance, no desire to do something more, for various reasons. Most often it is a lack of trust in the judicial system, the long duration of the proceedings, damage to health - mental crisis, loss of will to live, suicidal thoughts, reasons of a financial nature, fear of running battles with the "powerful" enemy and fear of not being able to find another job. There are few cases in Macedonia that the employee gives up everything and quit her job, she said.
The consequences of mobbing affect the lives of the victims.
